This “Privacy Policy” describes the privacy practices of and governs how Harvest Hosts Opco LLC and our subsidiaries and affiliates (collectively, “Harvest Hosts”, “we”, “us”, or “our”) collects, processes, and uses Personal Information (as defined below) relating to the users and visitors (collectively, “you”) of the Harvest Hosts website (www.harvesthosts.com), the Harvest Hosts mobile application, the Boondockers Welcome website (www.boondockerswelcome.com) and the Escapees website (www.escapees.com) (each of which may also be accessed through the Harvest Hosts mobile application), the searchforsites mobile application and website (www.searchforsites.co.uk), the CampScanner website (www.campscanner.com), and the Brit Stops mobile application and website (www.britstops.com) (collectively, the “Website”) and which posts or links to this Privacy Policy, and the rights and choices available to you with respect to your Personal Information.
This Privacy Policy, which is incorporated into our Terms of Use, applies to your use of the services available or enabled via any mobile applications of Company, its parents, affiliates or agents and/or the Website, including those that allow guest users to browse, view, choose, and reserve Host Locations (collectively, the “Services”). By using the Services, you agree to this Privacy Policy, which may be updated by us at any time. You should review this Privacy Policy carefully. If you do not agree with it, you may not use the Services. By using the Services, you confirm that you understand and agree with the provisions of this Privacy Policy. Please note that if you do not provide certain Personal Information to Harvest Hosts when requested, we may not be able to provide you with access to all areas of the Services.
This Privacy Policy applies only to the Personal Information that we may collect through the Services and does not concern any third-party website, mobile application or devices to which the Services may link or connect.

Information you provide to us:
Personal information (any information that identifies, could be used to identify or is otherwise associated with an individual person, which is in the possession of, or is likely to come into our possession (or the possession of our representatives or service providers), and includes the definition of “Personal Information,” “personal data,” and similar terms under applicable laws and regulations relating to data protection and privacy, collectively, “Personal Information”) you provide to us through the Service or otherwise includes:

Payment information, we may collect your payment card information and billing address if, for example, you sign up for a membership or to receive other Services requiring payment. To keep your financial data secure, we have contracted with a third party to maintain and process your payment information.

We obtain this information in order for us to be able to provide the Services to you and to otherwise meet our contractual obligations to you.
Information we obtain from social media platforms
We may maintain pages for the Services on social media platforms, such as Facebook, Instagram, Twitter, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your Personal Information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy. We obtain this information in order for us to be able to provide the Services to you and to otherwise meet our contractual obligations to you.
Information we obtain from other third parties
We may obtain your Personal Information from other third parties, such as entities we acquire or marketing partners. We rely on our legitimate interests to obtain this information in order to provide better Services to you. If we obtain your information from third parties, we will make sure to provide you a timely notice of our Privacy Policy if you have not had an opportunity to review it.
Information we collect about Registered Hosts
We collect Personal Information from you if you sign up to join as a host (“Registered Host”). The information you provide to us may include your first name, last name, email address, business name, business address, and phone number to enable us to provide the Services to you. As a Registered Host, you may also provide us with testimonials and reviews regarding our Services, and we rely on our legitimate interests to process that information. Registered Hosts may choose to upload pictures, video, and any other information about the Registered Host’s business on our Services. Registered Hosts can also choose to provide links to their website or social media pages, such as Facebook, on our Services.
Cookies and Other Information Collected by Automated Means
We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and activity occurring on or through the Services, including but not limited to:

Device data, such as your computer or mobile device operating system type and version number, manufacturer and model, device identifier (such as the Google Advertising ID or Apple ID for Advertising), browser type, screen resolution, IP address, the website you visited before browsing to our website, and general location information such as city, state, or geographic area.

In our mobile application, we may collect this information directly or through our use of third-party software development kits (“SDKs”). SDKs may enable third parties to collect information directly from our mobile application. We may use analytics and session replay technologies, such as Microsoft Clarity, to help us understand how users interact with the Services. These technologies may record information regarding user interactions, including mouse movements, clicks, scrolling activity, navigation paths, and other engagement data, which we use to improve the functionality, performance, and user experience of the Services. As described in greater detail in our Cookie Policy, we may work with third-party analytics and advertising partners, including providers such as Google and Meta, who may use such technologies to collect information about your interactions with the Services for analytics, advertising measurement, and targeted advertising purposes.

Referrals Users who have registered an account on our Website (“Registered Users”) may have the opportunity to refer friends or other contacts to us. Hosts and other users, in our legitimate interests, or to perform a contract with you. We may share your Personal Information with Registered Hosts and other Registered Users of the Services where you make bookings, only as we deem necessary to facilitate the bookings. This exchange of information is essential to the operation of the Services.

Other Users of the Service and the Public. We may provide functionality that enables you to disclose Personal Information to other users of the Services or the public. For instance, you may be able to maintain a user profile with information about yourself that you can make available to other users or the public. You may also be able to submit content to the Services (such as comments, reviews, surveys, blogs, photos, and videos), and we will display your name and user profile along with the content you submit. We do not control how other users or third parties use any Personal Information that you make available to such users or the public.

Host location information on third-party mobile apps. We may provide name and location information of Registered Hosts on certain third-party mobile apps providing navigation and mapping services to feature and advertise the Host locations to the users of such third-party services.

Professional advisors, in our legitimate interest or as required by law. We may disclose your Personal Information to professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us. For compliance, fraud prevention and safety, in our legitimate interest or as required by law. We may share your Personal Information for compliance, fraud prevention and safety purposes described above.

Acquirer of or investor in our business or assets. We may sell, transfer or otherwise share some or all of our business or assets, including your Personal Information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, investment, reorganization or sale of assets, or in the event of bankruptcy or dissolution. Harvest Host reserves the right to further share your Personal Information in connection with, or during negotiations of, any proposed or actual merger, purchase, sale, or any other type of acquisition or business combination of all or any portion of our assets. All these third parties will be expected to be subject to confidentiality requirements (either by contract, professional obligation, duty or otherwise) that require them to only use your Personal Information for the purposes as described above.
Your Choices
In this section, we describe the rights and choices that may be available to you depending on the jurisdiction in which you reside:
(i) if you have a membership account on the Services, you can upgrade or cancel your membership and update your profile information, such as your name, email address, and password, by logging in to your account;
(ii) confirm whether we process your Personal Information and to obtain information regarding the processing of your Personal Information and access to the Personal Information about you that Harvest Hosts holds;
(iii) request that Harvest Hosts corrects and updates your Personal Information if it is inaccurate or incomplete;
(iv) request deletion of your Personal Information (but please note that there may be circumstances where we are legally entitled to retain Personal Information regardless of any such request);
(v) object to the processing of your Personal Information;
(vi) request us to restrict, anonymize or block the processing of your Personal Information;
(vii) receive a copy of some Personal Information in a structured, commonly used and machine-readable format and/or request that Harvest Hosts transmits that data to a third party where this is technically feasible;
(viii) if we have collected and processed your Personal Information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing, use or disclosure we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent; and
(ix) lodge a complaint with a data protection authority about our collection and use of your Personal Information. More information is given below under the “Complaints” paragraph.

When you contact us about your Personal Information, you may be asked to provide evidence of your identity (e.g., driver’s license or passport). These types of safeguards are designed to ensure that only you, or someone authorized by you, has access to your file. Please note that exercising certain rights may limit the Services that we are able to provide.
Certain U.S. states have privacy laws applicable to us that grant their residents rights in addition to those otherwise described in this Privacy Policy (e.g., the right to appeal our denial of any request validly submitted). However, these rights are not absolute and some state privacy laws do not provide these rights to their residents. Therefore, we may decline your request in certain cases as permitted by law.

We send emails to your provided email address, such as our magazine or our brochures. Some of these emails may be tailored to you, based on your interests and any other information we may hold.
We also send you information through the mail, such as our magazine and our brochures, and if you have provided your phone number we may contact you by telephone for the purposes for which you have provided this (e.g., to keep you updated on our developments).
Opt-out of marketing communications.
You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us at team@harvesthosts.com. You may continue to receive service-related, transactional, and other non-marketing emails. For any recurring promotional and personalized marketing text messages, you may opt out by replying “STOP” from the mobile device receiving the messages. Your option not to receive promotional and marketing material shall not preclude us from corresponding with you, by email or otherwise, regarding your relationship with us (e.g., your account status and activity or our responses to questions or inquiries you pose to us), including our employees, contractors, agents and other representatives, from accessing and viewing your Personal Information for our internal business purposes; and shall not preclude us from disclosing your Personal Information as described in this Privacy Policy for purposes other than sending you promotional and marketing materials.
Targeted online advertising.
You may also see ads for our Services on third-party sites, including on social media. These ads may be tailored to you using cookies (which track your web activity, so enable us to serve ads to customers who have visited our Website). Where you see an ad on social media, this may be because we have engaged the social network to show ads to our customers, or users who match the demographic profile of our customers. If you no longer want to see tailored ads you can change your cookie and privacy settings on your browser and these third-party websites.
Some of the business partners that collect information about users’ activities on or through the Services may be members of organizations or programs that provide choices to individuals regarding the use of their browsing behavior or mobile application usage for purposes of targeted advertising. Security Practices
The security of your Personal Information is important to us. We employ a number of organizational, technical, and physical safeguards designed to protect the Personal Information we collect. However, security risk is inherent in all internet and information technologies and we cannot ensure or warrant the security of the Personal Information you transmit to us through the Service and you do so at your own risk. Data retention
The period for which we will hold your Personal Information will vary and will be determined by the following criteria:

Children
The Service is not directed to, and we do not knowingly collect Personal Information from, anyone under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us. International Data Transfers
We are headquartered in the United States and have service providers in other countries, and your Personal Information may be transferred to the United States or other locations outside of your state, province, or country. By accepting the terms of this Privacy Policy, you acknowledge and accept the processing of your Personal Information on servers located in the United States and in states, provinces or countries outside of your own. We reserve the right to modify this Privacy Policy at any time. If we make changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Website. We may, and will if required by law, also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via e-mail (if you have an account where we have your contact information) or another manner through the Services. Any modifications to this Privacy Policy will be effective upon our posting the new terms and/or upon implementation of the new changes on the Services (or as otherwise indicated at the time of posting). California Residents’ Privacy Rights
The CCPA grants individuals the following rights:

Information: You can request information about how we have collected, used, and shared your Personal Information during the past 12 months, including: (i) the categories of Personal Information we have collected about you, (ii) the categories of sources from which the Personal Information is collected, (iii) the business or commercial purpose for collecting your Personal Information, (iv) the categories of third parties with whom we have shared your personal information, and (v) the specific pieces of Personal Information we have collected, used, and shared.

Access: You can request a copy of the Personal Information that we collected about you.

Deletion: You can ask us to delete the Personal Information that we collected or maintain about you and tell our service providers to do the same.

Opt-out: You can ask us to not share your Host name and Host location information with third-party mobile apps, as described in the “How We Share Your Personal Information” section of the Privacy Policy. Any disclosures we provide will only cover the 12-month period preceding the receipt of a verifiable consumer request. We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing. Please note that the CCPA limits these rights by, for example, prohibiting us from providing certain sensitive information in response to an access request and limiting the circumstances in which we must comply with a deletion request. If we deny your request, we will communicate our decision to you. You are entitled to exercise the rights described above free from discrimination.
The California Online Privacy Protection Act also grants you the right to review and request changes to the Personal Information we have collected about you. You may do so by following the instructions in the “How to Submit a Request” section below.
Additionally, you have the right to not experience discriminatory treatment, and we will not discriminate against you, because you have exercised any California consumer privacy rights. We do not use the fact that you have exercised or requested to exercise any CCPA rights for any purpose other than facilitating a response to your request.
California Shine the Light Law.
Under California Civil Code section 1798.83, California residents are entitled to ask us, once a year and free of charge, for a notice identifying the categories of Personal Information which we share with our affiliates and/or third parties for direct marketing purposes and the contact information for such affiliates and/or third parties in the immediately preceding calendar year. You must put the statement “Your California Privacy Rights” in your request and include your name, street address, city, state, and ZIP code. We are not responsible for notices that are not labeled or sent properly, or do not have complete information.

Identity Verification
The CCPA requires us to verify the identity of the individual submitting a request to access or delete Personal Information before providing a substantive response to the request. We may therefore require you to send us proof of your identity before responding, such as address, date of birth, state or country of residence, telephone number, email address or details of a transaction. In addition, if you ask us to provide you with specific pieces of Personal Information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request. We will use the information you submit and the information we have in our systems to try to verify your identity and to match the Personal Information we have collected about you, if any, to your identity.
Authorized Agents
California residents can empower an “authorized agent” to submit requests on their behalf. We will require (i) verification of your identity directly with us (as described above) and confirmation you provided the authorized agent permission to submit the request and (ii) the authorized agent to have a written authorization confirming that authority (e.g., via a notarized letter).
Additional Disclosure for Residents of Canada
Transfer Of Data.
Harvest Hosts and its third-party hosting service providers primarily store data about you, including Personal Information, on servers located and operated within the United States. If you reside or are located outside of the U.S., we may send and store your Personal Information (also commonly referred to as personal data) to the U.S. in order to provide and operate the Services. By accepting the terms of this Privacy Policy, you acknowledge the transfer to and processing of your Personal Information on servers located in the U.S.

The Canadian Personal Information Protection and Electronic Documents Act (“PIPEDA”) provides certain rights to Canadian residents. We may require you to send us proof of your identity before providing you with access to your Personal Information.
